General Terms and Conditions (GTC) – Toolio.ch

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through the Toolio.ch online shop. By placing an order, the customer accepts these GTC in their currently valid version. Deviating terms and conditions of the customer are not accepted.

3. Offer and conclusion of contract

  • The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.

  • By placing an order, the customer makes a binding offer to conclude a contract.

  • The contract is concluded as soon as Toolio.ch confirms the order by email or ships the goods.

4. Prices and shipping costs

  • All prices are in Swiss francs (CHF), including VAT.

  • Shipping costs are shown separately during the ordering process.

  • Toolio.ch reserves the right to change prices at any time, whereby the prices valid at the time of the order shall prevail.

5. Terms of payment

  • Payment can be made using the payment methods offered in the shop (e.g. credit card, TWINT, PayPal, prepayment, invoice).

  • In case of late payment, Toolio.ch reserves the right to charge reminder fees and default interest.

6. Delivery

  • Delivery takes place within Switzerland to the address provided by the customer.

  • Delivery times are non-binding unless they have been expressly confirmed in writing.

  • If a product is unavailable, the customer will be informed. Toolio.ch reserves the right to withdraw from the contract if delivery is permanently impossible.

7. Retention of title

The goods remain the property of Toolio.ch until full payment has been made.

8. Right of withdrawal and return

  • Customers residing in Switzerland have the right to return the goods received within 14 days without giving any reason.

  • Returns are at the customer's expense and risk, unless the error was caused by Toolio.ch.

  • The following are excluded from the right of withdrawal:

    • Opened or used goods

    • Custom-made and personalized products

    • Hygiene or consumables

  • If the goods are returned on time and undamaged and in their original packaging, the purchase price will be refunded.

9. Warranty

  • The statutory warranty according to the Swiss Code of Obligations (CO) applies.

  • Obvious defects must be reported in writing immediately after receipt of the goods.

  • Toolio.ch may, at its own discretion, replace defective goods or refund the purchase price.

10. Liability

  • Toolio.ch is only liable for damages resulting from intentional or grossly negligent conduct.

  • Liability for slight negligence as well as for consequential damages, lost profits or other indirect damages is excluded.

  • The mandatory statutory provisions of the Product Liability Act remain reserved.

11. Data protection

  • Toolio.ch undertakes to treat customers' personal data confidentially and to use it only within the framework of applicable Swiss data protection laws.

12. Applicable law and place of jurisdiction

  • Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  • The place of jurisdiction is the registered office of Toolio.ch, unless a mandatory statutory place of jurisdiction applies.
